Car insurance is compulsory for all car owners. Most often it is called OSAGO or OSGPO (Compulsory Insurance of Motor Civil Liability), it is also mandatory state protection in the event of an accident. In simple terms, the car owner insures him against the most unpleasant situations that may arise during parking or driving on the road. Most often it is an accident, car theft, various kinds of damage or other weather phenomena.

Since OSAGO is mandatory, there are accordingly rules and penalties in case of its absence. In order to settle the rules, fines and various kinds of misunderstandings, the State Duma decided to amend the relevant bills. On the one hand, they secured drivers from unscrupulous insurers, on the other hand, they divided the drivers into those who understand responsibility for their actions and those who repeatedly break the law. We propose to consider the main changes, innovations, as well as what awaits car owners after the CMTPL reform in 2019.

Many will say why the CTP reform is needed, if everything is stable anyway. In fact, all the edits are necessary for the pricing of the market to become fair. All actions and factors that affect the accident rate must be taken into account. Before the amendments, insurance agents could not take into account the situation regarding tariffs, especially how accurately the driver drives.

How to get OSAGO insurance?

Each car owner has a question: "How to issue MTPL?" For novice drivers, this is a whole test, because they have previously heard a lot of stories about deception or further payment of compensation. The procedure for obtaining insurance itself is not complicated, you just need to carefully read the documents and remember what to expect later (type of compensation).

Today, there are two main ways to get car insurance. The first is to come directly to the office of the insurance company and, with the help of the manager, choose the best option for you. If there is not a lot of free time, then there is an opportunity to apply for a policy via the Internet, using a computer, tablet or smartphone.

You can issue OSAGO in any insurance company, which should be selected in advance. For registration in the office with the help of a manager, you will need a passport of a citizen of the Russian Federation, a driver's license, a registration certificate for a car; for enterprises and organizations, you must additionally have an extract from the Unified State Register with you.

This is the main list of documents, depending on the role of operation, age and category of the car, the list can be supplemented with additional extracts. After the documents are submitted in the office, the manager calculates the amount of insurance, as well as the price to be paid for OSAGO. As a rule, payment for the policy takes place in the office itself, more often to the manager.

As a result of registration of all policy documents, the driver must receive:

  • original policy;
  • windshield sticker;
  • European protocol form;
  • a receipt for payment of the insurance policy.

In the case of registration of OSAGO insurance via the Internet, then the procedure here will differ, both for entering data and obtaining the relevant documents. First, select a suitable insurance company, then look for a section to issue a policy or buy. Once on the appropriate form, we enter the data of the driver's license, passport data, information about the car.

Here, the calculation of the cost of insurance immediately goes. The last thing you need to do is pay for your policy. In most cases today, this can be done directly on the site itself. Previously, you had to go to the bank or the office of the insurance company. Finally, we print out a copy of the electronic policy and bring it with us in the car. Previously, traffic police inspectors did not recognize this type of insurance, and often it was possible to get a fine. Now this option of OSAGO in a new way does not differ from the one issued in the office and has the same legal force.

What will the new policy forms be like?

According to various sources, new insurance policy forms should appear by mid-autumn. In particular, for auto insurance, they decided to remove all unnecessary items, as well as simplify the form. This will allow you not only to easily understand what to expect from such insurance, but also to reduce the time for paperwork.

The maximum that can still change is the design of the form itself, where the registration number, the new spine and the compensation rules in the European protocol are more clearly indicated. Such innovations concern only paper policies, as for the electronic version, it will most likely remain the same.

Will they be revoked if there is no insurance?

Rumors that drivers without insurance will be deprived of their rights have been circulating on the Internet for more than one month. Many believed that this would not happen, but as practice and time showed, such a nuance was introduced as an addition to the basic rules. Inspectors have previously repeatedly checked drivers for the lack of insurance, but now they will be deprived of their rights for this. The whole point is that drivers who have issued MTPL and drive carefully are in no way protected from those reckless drivers who provoke accidents without insurance at all.

Therefore, amendments were made that for the first time driving without insurance the car owner will be released, for the second time they may be deprived of their rights for at least two years. It is also worth noting that all data is entered into a single traffic police database, and the trick with restoring documents based on a statement about their loss will no longer work.

In addition to the edits, there will be new rules, more precisely, the responsibility for the accident. If the license plates are deliberately stained, they can be deprived of their rights for this. They can also be deprived of their rights if the culprit left the scene of the accident or even provoked and disappeared, while his car was not damaged in any way. In other words, the culprit will now be punished to the fullest extent, and not just by a fine for insurance. It is not yet specified for how long the driver's license will be deprived.

We issue an accident according to the European protocol

Another very pleasant amendment to the CMTPL rules turned out to be the design of the accident reports according to the Euro standard. These rules began to operate this fall and now, with a minor accident and the mutual consent of the drivers, it will be possible to resolve the situation without calling the traffic police inspector. To do this, the culprit and the victim in the accident must fill out the relevant documents of the European protocol in order to receive compensation under the OSAGO insurance in the future and continue to go about their business, thus saving time and nerves. Since October 2019, the same protocol can be issued electronically by adding photos of the accident, a description and an electronic signature in the form of an entered username and password from the OSAGO account. It is possible that if fraud is detected, the action of such a euro protocol and insurance will be suspended, and both drivers will have to appear at the traffic police department.

According to various sources, there are about 4 million cars with fake policies on the roads of Russia. It is almost impossible to find such a car from the black list with lightning speed. This again brings us back to the situation when an innocent, neat driver who suffered in an accident will not be able to receive insurance compensation payments, since the culprit has counterfeit insurance. Often, even traffic police inspectors can make a mistake and, having drawn up a European protocol, make a mistake.

The driver is listed and not included in the insurance

It's good if the driver is included in the new OSAGO policy, but if the insurance was issued before the verbal permission to drive the vehicle, and there is no way to enter it into the form. The situation is very typical and occurs quite often.

So, according to the law, voluntary CASCO insurance and compulsory MTPL insurance are recognized. These policies imply different types and procedures of compensation. Prior to the amendments, there was a judicial practice that payments were made by the insurer of the guilty party, provided that the car was insured.

Now, in the case of registration of OSAGO insurance, where all permissible drivers are entered, the payment will be made by the insurer. In the case of using CASCO, but the driver was not included in the insurance, the insurer will pay the amount of damage to the injured party. Further, in court, he will withdraw the same amount from the driver who has committed an accident, which was not included in the policy. Thus, compensation for OSAGO remains unchanged, but the owners of CASCO will have to think about if they transfer control of the vehicle to another driver.

What's better? Paper or electronic insurance policy?

Until recently, the electronic insurance policy was practically inactive. In fact, he is, but the traffic police did not recognize him. The main reason is that the document was printed on a regular paper sheet, without wet printing and holograms. Now they have made changes in which paper and electronic insurance received the same rights, that is, they were equalized.

In addition to equal rights, changes have also been made to the consequences of the payment. If earlier the culprit of an accident could refuse recourse (medical examination), with the exception of obvious signs of intoxication, now, if the insurance company demands, the culprit of the accident will be obliged to undergo a medical examination. Accordingly, the rules for payment of compensation for damage have changed.

Until recently, a driver who committed an accident and refused a medical examination paid a fine of 30 thousand rubles, was deprived of his license for a year and did not pay the injured party for the damaged car at all. Regardless of whether it was CASCO or OSAGO. The amendment to the law changed the rules, in case of refusal to recourse, the culprit pays all further compensation, and the insurer only monitors the process, thereby passing to the injured party.

Hence, it turns out that regardless of the type of insurance policy issued, electronic or paper, they have the same status. It is enough to carry with you a printed copy with the number and name of the insurance company. The inspector simply enters this data into a computer or tablet to check all reliable data. Thus, the duplication of policy numbers has now been eliminated, and the accounting bases for electronic and paper insurance have become unified.

Claims against the insurer for compensation

Often a situation arises that the injured party does not agree with the terms and amount of compensation of the insurance company. As a rule, the amount is significantly lower than what is needed to restore the car or compensate for moral damage. The new changes took effect on January 1, 2019, but the main plus is that they were deprived of their validity period. Previously, similar changes were made on July 1, 2017 and were valid until January 1, 2019. It turns out that they were extended and deprived of their validity period.

The main revision is considered CTP. Previously, the injured party filed a lawsuit, in case of disagreement with the conditions and the amount of compensation payment by the insurance company (disagreement between the victim and the insurance company). Now, the injured party must re-apply to the insurance company, setting out in writing a claim for compensation. In turn, the insurance company must consider the application within 10 days.

A duplicate of the written statement remains with the injured party. If the insurance company, be it CASCO or OSAGO, within 10 days did not come to a common decision or, much worse, did not respond at all to the appeal of the injured party, then it will become much easier to win the pre-trial claim, and the amount of compensation can be set for a duplicate application.

How much does insurance cost in 2019?

It is no secret that the cost of a CASCO or MTPL insurance policy depends on the characteristics of the car and other conditions that are negotiated individually at the office of the insurance company. There are many online calculators on the Internet, where it is enough to enter the necessary data and the system will automatically select the cheapest and most reliable option.

On average, the minimum price of OSAGO insurance for car categories B and BE was 2058 rubles. (previously it was 2573 rubles). Upper threshold 2911 r. (was 3087 rubles). Taxi owners will have to pay the most. The minimum insurance threshold will be 4110 rubles and 7399 rubles, respectively, for categories B and BE.
